How is drunk driving penalized in Florida?
When someone is arrested for drunk driving, the court considers a variety of factors before assigning possible penalties. These factors can include the driver's past record, blood alcohol concentration (BAC) when arrested, and whether anyone else was affected by the offense.
Penalties for a first-offense DUI can consist of:
- Six to nine months in jail
- Up to $2,000 in fines
- License suspension for 180 days to one year
- Mandatory interlock ignition device (IID)
- Alcohol abuse counseling
Florida's lookback period is five years for a second offense and 10 years for a third offense, which is the period of time that prior convictions are relevant for current sentencing. While a BAC at or above .08 is considered illegal, penalties can be increasingly more severe for those with a BAC of .15 or higher.
